[계약법] Capacity 스터디 📔

- Enforceable contract 을 체결할 때,  계약 당사자는 반드시 계약 체결 능력을 가지고 있어야 한다. 

- Vulnerable contract parties 를 보호하기 위해서...

- Limited Capacity로 간주되는 경우: (1) minors (2) mentally incapacitated persons (3) the intoxicated (4) corporations.  

- Minors (18세 이하) : 미성년자와 제3자와의 계약은 minor's petition에 의하여 voidable (무효로 될 수 있음) 

- Valid Contracts (유효한 계약)

- Contracts which are beneficial to the Minor: 비록 for the minor's benefit 이라도, 즉 미성년자를 위한 계약 체결이라도 the term of the contract이 unreasonable한 경우 - unenforceable 

13세부터 16세 사이 미성년자 고용은 법령에 의하여 제한
